    LOTS 8 9 & 10 BLK 4 BUENA VISTA REC 463482 Hello BV, This East Main Street lot was given a special use permit for a number of short term rentals, I believe. Will that allowance transfer with a land sale?

    Our Code (Sec. 16.06.6.5.2.C.6.c) states:  "A special use permit may be transferred to another person to operate the same use, in the same building(s), on the same property, and under the same terms of the permit. Such transfer shall require approval by the Town Administrator upon a written request by holder and transferee."

    The buyer of the lots should obtain the Special Use Permit Resolution as approved by the Town's Planning & Zoning Commission in order to ensure they can comply with all the stated conditions. If any of those conditions need altering, it would require a new Special Use Permit process.

    Hello BV Planning. Did the town sell the 2 lots on Beldan? If so, will the proceeds be earmarked for anything?

    One lot is under contract to sell, the other is still on listing for sale. The sale proceeds will go into our General Fund balance in order to be available for other priorities as identified by the Board of Trustees.

    What is the current status of the Stackhouse addition? I thought it was voted down, but see some things in the current Chaffee County Times that lead me to believe otherwise!

    During their April 11th meeting, the Board of Trustees voted to approve the annexations, but did not reach the super-majority required to approve the zoning of the property. Since the annexation was contingent on the zoning, the annexations will not become effective.

    Hello BV. I listened to most of the work session. 2 vs 3 stories was discussed and the takeaway seemed to be that 3 stories will no longer be allowed if codified. I appreciated Trustee Volpe advocating for compromise between businesses and historical guidelines. Any idea if there be room for that with 3 stories?

    Thanks for the question. Staff and the Historic Preservation Commission will be working, based on direction from the Board on March 8th, to develop a framework for regulation within the ADG area - it is too early to say whether three stories will be allowed, however the clear intent from the Board was not to develop inflexible regulation, so the idea of baking in flexibility and consideration of unique circumstances for each project will need to be represented in the forthcoming framework. This framework will come back to the Board for input and guidance before moving into legal drafting.

    Hello BV. Is it true the town is considering codifying Historic Architectural Design Guidelines? If so - will 3 stories no longer be permitted on East Main Street? Thank you.
