Applicant presented to the Board during work session

On February 9th, 2021, Alex Telthorst presented his concept for the subject property and annexation to the Board of Trustees in a work session. The Board discussed the ramifications of the annexation with conversation focusing on water and housing.

Application for Annexation and Zoning Received

A complete annexation petition application was filed, along with the corresponding application fees. Staff then worked to ensure the submitted documents were complete, accurate, and free from errors. 

January 11 2022

Notification of receipt of annexation application to Board of Trustees

As required under state statute, Town staff formally notified the Board of Trustees that the Stackhaus LLC had submitted a complete application for annexation and zoning for 15750 CR 306. A timeline showing how the annexation petition could be reviewed in accordance with state law was presented to the board for approval.

January 12 2022

Special notice sent to landowners of properties abutting the 'flagpole' annexation

This special notice is required by state law and serves to notify the abutting landowners that an application for annexation has been filed. The notice also notifies them that they have the option to join the petition for annexation as long as they:

  1. Agree to the same terms and conditions of the petitioned annexation; and
  2. Submit a complete petition for annexation of their property at least 45 days prior to the scheduled annexation hearing.

Landowners are not required to join the annexation.

Board to consider acceptance of the petition

The Board will hear a presentation from Town staff on the annexation petition. If the board deems the petition is complete and that the subject property along with the flagpole section of CR 306 meet the state-mandated eligibility criteria for annexations, the Board may choose to accept the petition. 

This acceptance does not imply or commit the Board to approving the annexation, it simply says 'the application is complete, and the properties are eligible to be annexed.'

In this meeting the Board will also set a date for the formal Annexation Public Hearing. Most likely this date will be April 12th, 2022.

Deadline for Abutting Landowners to Submit Petition to Join

As detailed in the special notice sent on January 12th, the landowners abutting the flagpole section of CR 306 may petition to join the annexation. February 25th is the deadline for this complete submittal. Please contact Planning Director Joseph Teipel if you are one of these landowners and you desire to join the petition.

Planning & Zoning Commission Public Hearing on Property Zoning

The processes for annexing a property and then applying a zone district to that property are two distinct processes under state law and Town Code. However, they can be conducted simultaneously.

This public hearing will be a chance for P&Z Commissioners to hear from Town staff on the applicant-proposed zoning for the subject property (R3), and consider whether to recommend or not recommend that zoning to the Board of Trustees.

Annexation & Zoning Public Hearing*

This public hearing will be where the Board of Trustees hears from the public, the applicant, and Town staff about the annexation and the proposed zoning (R3). 

The Board will choose to approve, approve with conditions, or deny the petition for annexation. 

After that decision, should it be to approve or approve with conditions, the Board will choose to approve the R3 zone district for the property or to apply a different zone district to the property.
