Applicants Joseph & Ashley Teipel are seeking to build a four-unit building on the Western edge of their property located at 124 Mill Street. This application entails three distinct applications and review processes:
Minor subdivision - to create a separate lot for the building to sit on
Administrative site plan review - required for a building of this type and size
Special Use Permit - as required for small-multi family uses in the MU-1 zone district
Because Joseph works for the Town's Planning Department, the minor subdivision and site plan review processes have been referred to the Planning & Zoning Commission for consideration alongside the Special Use Permit. In addition, the Town's independent planning and engineering consultants RG & Associates are conducting the staff report and process coordination work. All these extra steps are in place to ensure no perception of, or real, special treatment for the applicant and this case.
This case will also require a Public Improvements Agreement to be approved by the Board of Trustees.
The applicant submitted their complete application(s) and paid the corresponding fees.
Staff Review & Referral Agency Comments

Staff review the application materials, ensure they fully and accurately represent the proposed project, and then send the relevant application materials out to over 20 referral agencies for comment.
These agencies include Sangre de Cristo Electric, Atmos Energy, the Buena Vista School District, and many more parties. Each party is given approximately 3 weeks to review the application and provide comment.
Comments can include things like special considerations from that party's perspective, notes on infrastructure or easements needed for the project, or other questions and concerns for the applicant and staff to consider.
Applicant Comment Response & Resubmittal

The staff review comments and referral agency comments are compiled and sorted through. If there are items that the applicant needs to address, these comments are sent back to the applicant along with detailed instructions on what to address.
The applicant is now responsible for resubmitting all requested materials that address the comments raised.
No further work will be done on this application while the Town staff await the applicant's resubmittal.
Applicants have 6 months within which to provide a complete response and resubmittal. If they fail to do so in this time frame, their applications will be abandoned and they will need to start over with a fresh application (and fees).

Applicants resubmit complete materials addressing all of the comments provided on their application(s). Staff then works to review the resubmittal and ensure it addresses all comments.
If there are lingering questions or substantive changes to the application, staff will resend the application to referral agencies.

If the application is considered complete and has addressed all raised concerns and comments, the staff will prepare a written report with recommendations for review by the appropriate decision making body.

Planning & Zoning Commission (special use permits, major site plans, major subdivisions, rezoning, and more)
